大不列颠及北爱尔兰联合王国的宪政制度：未成文宪法的历史、渊源与制度之比较宪法研究

大不列颠及北爱尔兰联合王国的宪法并未编纂成一部统一法典，而是在数百年间由联合法案及条约、重要历史文件（《大宪章》《权利请愿书》《人身保护法》《权利法案》和《王位继承法》）、普通成文法、普通法及宪政惯例逐步形成。本文追溯英国国家的历史形成，说明集体记忆如何比单一的制宪权更能帮助人们识别具有宪法价值的规范。文章考察国内及超国家层面的宪法渊源，并分析经验理性主义、戴雪所阐述的法治以及议会主权等基本原则，同时指出内阁的主导地位在实践中限制了议会主权的实际范围。研究还介绍王室、两院制议会、政府和首相，以及未经统一编纂的基本权利保障。最后，文章讨论脱欧及制度信任危机带来的当代挑战。英国制度虽灵活且富有韧性，但缺少统一宪法文本，使传统惯例与要求更明确成文规则之间的张力持续存在。
